This page states the terms and conditions under which you use the deludedmonkey.com website.  Any use of this website means that you have read and agree to the terms and conditions.  Deluded Monkey provides this website for personal use only.  It should not be used for any commercial use nor should it be modified or altered in any way.  If you do not agree with these terms and conditions then you are not authorised to use deludedmonkey.com.


1.  Deluded Monkey and how do you get in touch?

Deluded Monkey is the trading name of a business based in London, England which operates the deludedmonkey.com website.  Deluded Monkey can be contacted by email at information@deludedmonkey.com or by letter at Deluded Monkey, PO Box 45556, London, NW1 0WS, United Kingdom.


2.  Payment for Goods and Delivery Charges

Deluded Monkey can only supply goods that are ordered online via the deludedmonkey.com website and will not accept orders by telephone or by post.  All payments including the delivery and handling fees, must be made by PayPal, Postal Orders and Cheques for United Kingdom orders and by PayPal for European and Worldwide orders.  All card transactions are completed on a secure server and Deluded Monkey uses PayPal to process all card transactions.


3.   Delivery Charges

The delivery charges are included in the price but for information and return purposes they breakdown per order as £6 for the United Kingdom, £10 for Europe and £20 for Worldwide. Please note that if you are ordering from outside of the United Kingdom then you may be liable to pay Customs Duties in you country.  It is up to the customer to be aware of any duties that they may have to pay and items cannot be returned due to the customer being liable to pay customs duties and not wishing to pay them.


4.  Delivery Times

Deluded Monkey aims to provide a 3-5 working days delivery for all orders in the United Kingdom and a 7-10 working days delivery for European and Worldwide orders.  Delivery times are from the date of the order and working days are Monday to Friday.  However there may be circumstances beyond Deluded Monkey’s control which cause delay and in such circumstances Deluded Monkey will endeavour to deliver the goods within 10 working days for orders in the UK and within 20 working days for all overseas orders.  Deluded Monkey uses Royal Mail to deliver its goods to the United Kingdom and overseas and cannot be held responsible for any delays caused by Royal Mail.


5.  Prices

Prices are as stated on the deludedmonkey.com website and are subject to change at any time without notice.  In the event of an item being priced incorrectly due to a typographical error, Deluded Monkey reserves the right to cancel the transaction and refund the customer.


6.  Deluded Monkey’s Warranties

Deluded Monkey is unable to provide any warranties in relation to the goods provided over and above its statutory obligation to provide goods of satisfactory quality in accordance with the Sale of Goods Act 1979 as amended by the Sale and Supply of Goods Act 1994.


7.  Deluded Monkey’s Limited Liability

Except in relation to liability for death or personal injury Deluded Monkey’s liability for negligence shall be limited to the total value of the transaction.  Deluded Monkey shall not be liable for any indirect, consequential, or special losses even if Deluded Monkey has previously been advised of the likelihood of such losses.


8.  Availability of the Website and Goods

Deluded Monkey will use all reasonable endeavour to ensure that the deludedmonkey.com website does not have any problems and that the items displayed are available.  However Deluded Monkey cannot guarantee the availability of the website or that any items on the website are in stock or available.  In the event that an item is ordered but has already been sold, Deluded Monkey will refund the customer within 2 working days of the order being placed.


9.  Intellectual Property Rights

All rights in the designs, graphics, texts and contents of this website are owned by Deluded Monkey.  They are protected by copyright and other intellectual property rights.  You may not copy, reproduce, modify, distribute, display, post or transmit any part of this site without permission from Deluded Monkey.  All trademarks, product names and company names or logos featured on this website are the property of its owner.


10.  Returns and Store Credits

Deluded Monkey is confident that you will be satisfied with any item you purchase.  However, Deluded Monkey is happy to provide a store credit or refund for any item you may wish to return.  Returns may be made provided the items have not been worn and are in the same condition as when they were sold on the deludedmonkey.com website.   The store credit or refund will not include the original delivery charges which breakdown per order as £6 for the United Kingdom, £10 for Europe and £20 for Worldwide. In the event that you wish to return an item to Deluded Monkey, contact must be made within 24 hours of receipt, giving the reason for returning the item.  The items must be returned within 5 working days of receipt in the United Kingdom and within 10 working days of receipt for European and Worldwide orders.  Please note that if you do have to return an item to Deluded Monkey, it is strongly recommended that you use a recorded delivery service as Deluded Monkey cannot be held responsible for any items lost in the post.  You will also be responsible for the costs of returning the items to Deluded Monkey.

11.  Privacy Policy

All the information you provide to Deluded Monkey including your email address, delivery address and any other information is strictly private and confidential.  Deluded Monkey acknowledges that it is bound by the Data Protection Act 1998 and that it will not disclose your details to any third party without your express written consent. Information given to PayPal for the purposes of the card transactions is strictly private and confidential and details of their privacy policy can be found here. As a matter of good practice, Deluded Monkey does not share any personal information with anyone and does not sell it to anyone.


12.  Disclaimers

Deluded Monkey is in no way affiliated with any of the brands mentioned on the website.  All photographs and measurements are taken to truthfully and accurately represent the items on the website but Deluded Monkey cannot be held responsible for any inaccuracies or colour misrepresentations due to resolution and monitor differences.


13.  Force Majeure

Deluded Monkey will not be liable for any breach of contract due to unforeseen circumstances such as floods, fires, breakdowns in machinery or industrial actions.


14.  Rights to Alter Terms and Conditions

The Deluded Monkey website is constantly changing and these terms and conditions may change from time to time.  Deluded Monkey reserves the right to change the terms and conditions without notice.

15.  Jurisdiction

This agreement will be governed by the laws of England and Wales and by using the website you agree to submit to the exclusive jurisdiction of the courts of England and Wales.
